Terms of Service

These terms are an agreement between you and TrackIt Financial, Inc. ("TrackIt", "we", "us") covering your use of the TrackIt app and this website. By creating an account or using the app, you agree to them.

1. Who can use TrackIt

You must be at least 18 years old and able to enter into a binding contract. You may only use TrackIt with bank accounts you own or are authorized to access. You are responsible for the activity on your account and for keeping access to your device and email secure.

2. What TrackIt is — and is not

TrackIt is an informational tool. It reads your account and transaction data and organizes it so you can understand your own spending.

TrackIt is not a bank, and we are not a financial adviser, broker, tax adviser, or accountant. Nothing in the app or on this site is financial, investment, tax, or legal advice, and nothing in it is a recommendation to take or avoid any particular action with your money. Decisions you make about your finances are your own. If you need advice, speak to a qualified professional.

TrackIt does not hold, move, or transfer money. We cannot make payments or transfers on your behalf.

3. Bank connections and Plaid

Bank connections are provided by Plaid Inc. When you connect an account, you authorize Plaid to access it on your behalf and to share the resulting account and transaction data with us. Your use of Plaid is also governed by Plaid's own terms and End User Privacy Policy.

Account data comes to us from your financial institutions through Plaid. It may be delayed, incomplete, or wrong for reasons outside our control — an institution may be unreachable, may change how it reports data, or may report a transaction differently from how it eventually settles. Your bank's own records are always the authoritative ones. Do not rely on TrackIt for anything where being exactly right matters, such as reconciling an account, filing taxes, or confirming a balance before you spend.

You can disconnect any account at any time, which revokes our access to it.

You keep ownership of the data you put into TrackIt. You grant us the licence we need to store, process, and display it in order to run the service for you — nothing more. Our handling of your information is described in our Privacy Policy.

We own the app, this website, and everything in them apart from your data. You get a personal, non-exclusive, non-transferable, revocable licence to use the app for your own use.

6. Paid features

Some features may require a paid subscription. Subscriptions bought through the App Store are billed by Apple, renew automatically unless cancelled at least 24 hours before the period ends, and are managed in your Apple account settings. Refunds are handled by Apple under its own policies. We will always tell you the price before you are charged, and we will give you notice before any price change takes effect.

7. Changes and availability

We may change, suspend, or discontinue any part of the service. We aim to give reasonable notice of significant changes, but we do not guarantee the service will be uninterrupted or error-free, and we may need to take it down for maintenance.

If we materially change these terms, we will update the date above and notify you in the app or by email before the change takes effect. Continuing to use TrackIt after that means you accept the new terms.

8. Ending your use

You can stop using TrackIt and delete your account at any time, from Settings in the app. We may suspend or terminate your account if you breach these terms, if we are required to by law, or if we reasonably believe it is necessary to protect the service or other users. Sections 2, 9, 10, and 11 survive termination.

9. Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the information in the app is accurate, complete, or current.

10. Limitation of liability

To the fullest extent the law allows, TrackIt Financial, Inc. is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost data, or financial losses arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Some jurisdictions do not allow these limitations, in which case they apply to you only to the extent permitted.

11. Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Delaware, and you and we consent to their jurisdiction. Before filing anything, please email us — most problems are faster to fix than to litigate.

12. General

If any provision of these terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and us about the service. You may not assign them; we may assign them in connection with a merger, acquisition, or sale of assets.
